Investment and residency

Buying here is a property decision, not a residency one.

We frame the questions early, then connect buyers with the right regulated advisers for formal advice.

Sequence matters.

Immigration route, tax residency, ownership structure and property selection should be reviewed as one decision — and in that order, because the first three constrain the fourth.

There is no investor visa

Spain’s golden visa — residence in exchange for a €500,000 property investment — was repealed and closed to new applications on 3 April 2025. Any page still offering it as a route into Spain or the Canary Islands is out of date. Permits already granted keep their renewal rights, but buying property now grants no residence right of any kind.

Other routes exist and none of them is bought. The non-lucrative visa and the digital-nomad visa each turn on income, insurance and circumstance rather than on a purchase, so the useful question is which one a specific plan supports — and whether it survives the 183-day tax line. Ask us and we will put you in front of counsel who can answer it formally.

Non-EU buyers: one extra authorisation

Freehold ownership is open to non-residents, and EU and EEA nationals buy on the same footing as Spaniards. For everyone else the Canary Islands are a designated defence zone under Ley 8/1975 and Royal Decree 689/1978 — both still in force — which makes some acquisitions subject to Ministry of Defence authorisation. Established urban areas are largely outside it, so a resort apartment is usually unaffected while rural land is the common case that is not.

It is a consent to obtain, not a bar, but it is established before signing rather than afterwards: whether a specific property needs it is a question for the notary and your lawyer on that plot.

Important boundary

Toponimo does not give legal, tax, immigration, or investment advice. Those decisions require jurisdiction-specific, regulated counsel.
